Terms & Conditions

I. INTRODUCTION:

• These Terms and Conditions in consonance with the Privacy Policy and Disclaimer form the complete agreement between Users and the Trust, and revoke any earlier agreement or understanding. However, these Terms may be altered continually, and it is the sole responsibility of Users to keep themselves updated of such changes. The Trust is not bound to provide prior notifications to Users of such changes, and the Trust assumes no liability for any loss caused to Users on account of being unaware of the amended Terms.


• Remittance of a payment on the App shall be deemed to be Users' acceptance of these Terms and Conditions. An express consent need not be given to this effect.

II. PROCESS OF MAKING PAYMENTS:

• Users are required to carefully read the Instructions provided on the login page of the App with regard to concluded and pending transactions, and strictly adhere to the same.
• Users may make payments through Credit/Debit Cards and/or Net Banking in accordance with their convenience. A Payment Confirmation Slip is generated on the App once payment is effected. In the event of a failure to complete payments, the reason for the same will be displayed.
• In the event the process is stuck in between before a User(s) enters her/his Card details and/or details for Net Banking, s/he may start the process all over again. Also, in the event the said Payment Confirmation Slip is not generated on completing the entire payment process, Users may contact their respective Banks to confirm that payments have been credited. They may then lodge a complaint on the App that the said Slip has not been generated on successful payments. However, in the event the respective Bank intimates Users that payments have not been credited, fresh payments have to be made on the App.
• Users are required to record the Reference Numbers of transactions for future references.

III. REFUND POLICY:

Users agree and acknowledge that payments once made will not be refunded/cancelled for any reason whatsoever. However, such refunds may be effected in the event of duplicate payments made by Users. They are required to lodge a request for the same on the App with the requisite details such as the Reference Number of the transaction.

IV. UNAUTHORISED USE OF THE CONTENT ON THE APP:

No matter on this App, either in full or part, should be reproduced as it is by Users or their affiliates. Users agree and acknowledge that they are not authorized to duplicate the same for their use unless they obtain the earlier written consent of the Trust. Such duplication will amount to unauthorized use, and will attract legal actions against the defaulter.

V. COVENANTS OF USERS:

• Users make the following covenants with the Trust:
• (i) They are legally entitled to use Credit/Debit Cards or avail Net Banking for payment transactions.
• (ii) They shall ensure that sufficient credit is available on the nominated card/ bank account at the time of settling payments.

VI. TERMINATION OF RIGHTS TO AVAIL THE SERVICES:

Users agree and acknowledge that their rights to utilize the Payment Gateway Services on the App may be terminated by the Trust without prior notice for reasons including misuse, and unauthorized use. They will be intimated of the reason for such termination. Once terminated, Users’ access to the Services cannot be reactivated.

VII. APPLICABLE LAWS:

These Terms and Conditions are governed by the Laws of India and rules and guidelines set out by the Reserve Bank of India from time to time.

VIII. ENTIRE AGREEMENT:

These Terms and Conditions, together with the Privacy Policy and Disclaimer form the complete Agreement between the Trust and Users. There is no other oral understanding or written document, which regulates these terms.

IX. DISPUTE RESOLUTION:

In the event disputes arise between Users and the Trust in relation to the access of the Payment Gateway Services on the App, the matter shall be referred to arbitration, and the seat of the Arbitrator shall be at Chennai, Tamil Nadu.

B. PRIVACY POLICY

I. SCOPE:

• The Trust appreciates the privacy of Users of the Payment Services on the App, and shall adopt all feasible methods for the protection of the same.
• This Privacy Policy administers any and all use of Users' non- public Personal Information on the App.
• Users agree and acknowledge that the employees of the Trust will have access to the said Information for the operation of the App. However, such access shall be limited and restricted, and on a need-to-know basis.
• Users also agree and acknowledge that their said Information is subject to hacking/theft in certain exceptional circumstances. The Trust shall not be held responsible for the same.
• The terms of this Privacy Policy shall be in force even in the eventuality of Users ceasing to access the Payment Gateway on the App.

II. APPLICABILITY:

The terms of this Privacy Policy are applicable and relevant to all individuals/entities who avail the Payment Gateway Services on the App

III. INFORMATION COLLECTED:

• The Information collected from Users may be listed out as here below:
• Name
• Mobile no
• Phone no
• Email address
• Shipping address
• Billing address

IV. UTILIZATION OF INFORMATION:

The aforesaid Information collected from Users shall be utilized for the sole purpose of receipt of payments, and not for any other purpose whatsoever.

V. LINKS TO THIRD- PARTY APPS:

This App provides for links/hyperlinks to other Apps operated by third parties. The Trust assumes no liability for the Personal Information shared by Users on these Apps.

VI. MODIFICATION OF POLICY:

This Policy is subject to changes periodically, and the Users acknowledge the same. They are required to do regular checks on the App to be apprised of such changes as and when made.

C. DISCLAIMER

I. INTRODUCTION:

Access of the Payment Gateway Services on the App by Users is also subject to the Terms of this Disclaimer. Remittance of payments through the App implies Users' agreement with the limitations and exclusions set out in the same.

II. PURPOSE:

The App has been developed exclusively for the purpose of facilitating payments by Users to the temple administered by the Trust. The Trust assumes no liability for any loss caused to Users on account of any other unauthorized use of the same.

The Trust is not responsible for any illegal transaction carried out by Users.

III. NO GUARANTEES:

The Payment Gateway Services on the App are subject to interruptions in unavoidable circumstances, and the Trust assumes no liability for any loss caused to Users as a result of the same. The Services may also be suspended temporarily for maintenance tasks, and the Trust assumes no liability for any loss caused to Users on account of the same either.

The Trust provides no guarantees with regard to an uninterrupted and continual access to these Services. Users also agree and acknowledge that the said interruption/suspension of Services may take place without prior notice to them.

IV. ASSUMPTION OF RISK:

Users agree and acknowledge that their access of the Payment Gateway Services on the App is exclusively at their own risk. The Trust assumes no liability for their sole reliance on the same.

V. THIRD- PARTY LINKS:

The App may contain several third party links/hyperlinks. Users agree and acknowledge that the Trust assumes no accountability for the content on the same or the services provided by the same.

Users may access these services at their own risk and discretion. The Trust puts forth no recommendations for the same either.

VI. INDIVIDUAL USERS:

Each User is required to select and use the payment mode appropriate and convenient for her/him. The Trust recommends no payment mode to be used by all Users in general.

VII. PRESENCE OF VIRUSES/HARMFUL COMPONENTS ON THE APP:

The App may contain viruses, and other harmful components, which may disrupt Services occasionally. The Trust assumes no liability for the same.

VIII. REVISION OF DICLAIMER:

This Disclaimer is subject to periodical revisions/amendments as applicable without prior notice to Users. They are required to keep themselves updated of such revisions through regular checks on the App.
